Terms of service

These Terms govern your use of The Frustration Condition (the "Service"). By creating an account, you accept these Terms.
1. Accounts
You must be at least 18 and authorized to bind your organization. You are responsible for safeguarding your credentials and for activity under your account.
2. Acceptable use
You agree not to submit unlawful, infringing, harassing content or identifiable special-category personal data; not to access another tenant's data; not to reverse-engineer or interfere with the Service; not to resell or build a competing product on it.
3. Roles
Workspace facilitators can create teams, invite participants, view aggregated patterns, run leadership tools, export workspace data, and delete the workspace. Team participants can join via a code and submit anonymous frustrations. Platform admins can manage tenants for support and billing.
4. Privacy
Use is also governed by the Privacy Policy. Where you act as a controller (e.g. inviting employees as participants), our Data Processing Agreement is incorporated. By signing up you accept its terms.
5. AI processing
Open-text responses are processed by AI sub-processors as described at /privacy/sub-processors. You may request a tenant-level opt-out.
6. Subscription, billing, cancellation
Paid plans are billed by Stripe. You can cancel anytime; service continues to the end of the current period. We retain workspace data for 30 days after cancellation in case you reactivate, then permanently delete it unless you request earlier deletion.
7. Intellectual property
You retain rights to content you submit and grant us a non-exclusive license to host, process, display back to your authorized users, and generate derived analyses solely to operate the Service for you. The Service, including the methodology and the underlying book The Frustration Condition, is © Dr. Tim Hough.
8. Confidentiality
We treat your workspace content as confidential and access it only to operate the Service, comply with law, or with your explicit instruction.
9. Warranties & liability
The Service is provided "as is". To the extent permitted by law our aggregate liability is limited to fees paid in the 12 months preceding the claim. Neither party is liable for indirect, incidental, or consequential damages. Statutory consumer rights are unaffected.
10. Security disclosure
Report security issues to security@frustrationcondition.com. We will not pursue legal action against researchers acting in good faith.
11. Termination & governing law
Either party may terminate at any time. On termination we delete your data per the retention schedule in the Privacy Policy. These Terms are governed by the laws of England and Wales; mandatory consumer-protection laws of your country still apply.
12. Changes
We may amend these Terms with 30 days' notice. Continued use after the effective date constitutes acceptance.
